These terms of business ("Terms") are the terms upon which Howards Estate Agents ("we" or "us") supplies survey reports and any other services ("the Services") to the customer ("you") and the information contained in them ("Information") to you.

1/ From time to time we may amend the format and content of the Services and any of the Information.

2/ You may provide Survey Information free of charge to a future purchaser of the property in which you already live or are considering living but you must not engage in any business involving the supply of the Information to any other person or business. You must not use the Information for any illegal purpose or to send information or communications which are offensive, abusive, indecent, defamatory, obscene or menacing.

3/ With the sole exception of trade clients with pre-agreed payment terms, you will pay us our charges, by a payment method we accept, before we send you the Information.

4/ You acknowledge that we may refuse to accept any order you make for any Services or Information at our discretion. In such circumstances, we shall reimburse you for any charges paid by you to us in relation to such refused order.

5/ You must not rely upon any Information as the only factor or source of information in making any decision. Further advice and information from appropriate experts and professionals should be obtained before making any decision.

6/ No intellectual or other proprietary rights in the Information are transferred or licensed to you. You must not do anything that infringes any intellectual property or other proprietary right in the Information.

7/ We shall not be liable to you for any breach of these Terms due (directly or indirectly) to the failure of any machine, data, processing system or transmission link or to industrial dispute or anything beyond our reasonable control or the acts or omissions of any party for whom we are not responsible.

8/ We shall not in any circumstances (whether for breach of contract, negligence or any other tort, under statute or otherwise at all) be liable for any indirect or consequential loss or damage at all, or any loss of business, capital, profit, reputation or goodwill.

9/ We shall accept liability for death or personal injury arising from our negligence.

10/ Our entire liability in respect of all causes of action arising by reason of or in connection with these Terms (whether for breach of contract, negligence or any other tort, under statute or otherwise at all) shall be limited to the amount you paid for the Services or Information (including VAT).

11/ If you want to make a claim against us in relation to the Services or Information you must give us written notice of the claim within 3 months of becoming aware of the circumstances giving rise to the claim or, if earlier, 3 months from the time you ought reasonably to have become aware of such circumstances. If you do not, we shall not be liable for the claim.

12/ You shall indemnify us against any claims or legal proceedings, brought or threatened against us by a third party, or loss or damage suffered by us which in either case is caused by your use of the Services or Information or caused by your negligent acts or omissions or non-compliance with these Terms.

13/ If any provision of these Terms is or becomes invalid or unenforceable, it will be taken to be removed from the rest of these Terms to the extent that it is invalid or unenforceable. No other provision of these Terms shall be affected.

14/ These Terms shall be governed by English law. You and we submit to the non-exclusive jurisdiction of the English Courts.
